Know your program

Workgroups

Often managers or partners have secretaries or assistants working for them and they need to manage or view these Matters from time to time to ensure that they are up to date and in order. LegalSuite does not have a specific facility to do this – you can either view your Matters or all Matters. The manager/partner’s Matters, however, may belong to a diverse number of other users and so it is difficult for him/her to view all the Matters that are under his/her control. 

To solve this issue, we added a Workgroups feature to LegalSuite which you will find quite useful. To create a Workgroup, go to Setup click on Employees double click on your User name and click on the Workgroups Tab then insert the names of the Employees who work for you into the list.

Once you have created a Workgroup, the program will offer additional options when Filtering Fee Notes, To Do notes etc (see below). In this case you will view To-Do Notes for any Matters belonging to your Workgroup, i.e. yourself, and all the people you selected for your Workgroup.

You will also be able to filter the Matters that belong to your Workgroup.

Also if you have any alerts set, the program will alert you to all the Matters belonging to your Workgroup rather than just your own Matters.

This will be more meaningful to many users who don’t really “own” any Matters themselves but have people working for them who they have to manage.

Please note that this is not tied to the Accounting system in any way. It is simply a management tool available on the Desktop. The users must still post fees to the appropriate Cost Centre to correctly allocate income etc.

Summary of Changes

MT69 - Legal property description The Legal Property Description message type (MT69) should no longer be sent to SBSA.  Should such a message be received on the LAW DSE, this message will be stopped and not passed to SBSA.  This message may still be used for other institutions.
MT66 - Amendment request The amendment request message type (MT66) must contain hard-coded options in the Reason field.  The Description field must be used for free format information that is meaningful and should be at least 30 characters long.
MT65 - Bond Type for LAW The Bond Type for LAW message type (MT65) must contain hard-coded options in the Reason field.  The Description field can be used for free format information and must be at least 30 characters long when used.
MT78 - Bond Delay reason A new Bond Delay Reason message type (MT78) has been added. Hard-coded options to be included in the Reason field for this message type and the Description field to be used for free format information that is meaningful. The Description field should contain at least 30 characters when used. A new field has been added for the Expected Resolution Date. This field is a mandatory field. This field is to be used to indicate to the Bank the date when the registration is estimated to continue.  Some of the institutions have their own specified hard-coded options and these will be displayed for their specific bonds.
MT61 - NTU Request New hard-coded options to be included for the NTU Request (MT61) from Attorneys. The hard-coded options to be included in the Reason field and free format information to be sent in the Description field. Any free format information sent in the Description field should be meaningful and must be at least 30 characters.
MT9 - Estimated Date of Registration The Estimated Date of Registration (MT9) is being re-instated into the workflow for all bond institutions. This message can be sent up until lodgement.
MT70 - Debit Order details The Debit order details message (MT70) will now be created and sent automatically at the same time as the attorney sends the lodgement (MT4) within LegalSuite. Should there be no debit order details completed in the database, the MT70 will still be sent to the Bank but the Reason field will contain the wording ALTERNATIVE PAYMENT METHOD. You will have an option to cancel the MT4 and MT70 and go back to complete the debit order details in the bond database.
MT79 - Re-Instate Instruction (FNB) A new message type Re-Instatement Instruction (MT79) has been included for Re-Instating NTU’d instructions. This message type will only apply to FNB. When a NTU Instruction (MT30) or Withdraw Instruction (MT29) is sent from the Bank, LegalSuite will automatically acknowledge this with either the MT19 (NTU notification) or MT18 (Withdraw Notification). The matter will not be archived. Should the Re-Instatement Instruction (MT79) be received within 90 days of NTU or Withdraw Instruction, LegalSuite will automatically acknowledge the MT79 with the Proceed Notification (MT12). The Bank will send an amendment which LegalSuite will also automatically acknowledge. The bond can then continue as per normal. Please note however when a MT30 or MT29 is sent, the Attorney will not be allowed to send any message type until the MT79 is received. If the MT79 is not received within 90 days of the MT30 or MT29, the matter will be archived on the Bank’s, Attorney’s and LAW’s systems.

Tip of the Day

Adjusting To Do Notes

We have improved the adjustment of To Do Notes. You can now move a To Do Note by a set number of days or to a specific date. You can also assign a To Do Note to a different user.

This can be done from two places on your desktop: 

From the To Do Notes Tab on your desktop. Right Click on the To Do Note you wish to adjust, then click on Adjust & Relocate.

or from the button in the Plan of Action screen:

Either way, it loads the following screen where you can either fill in the number of days you wish to adjust the To Do Note with or set it to a specific date. You can also reallocate it to another user on your system by ticking the "Assign to another Employee?" option and choose the relevant person from the drop down list.

Should you wish to do adjust more than one To Do Note at a time, simply tag the relevant To Do Notes and make the necessary changes.

Attorney Circular 9/2006 - New Developments

 

It is of great concern to us that properties are being registered prior to any request for the retentions to be up-lifted despite it being a condition of the loan. 

In future all new sectional title and full-title development instructions bearing the following condition : “Registration is subject to the 100% completion of the unit and final inspection must be referred to the Bank prior to registration for the up-liftment of the retention.  Once you have received confirmation from the Bank that the retention has been up-lifted AND that the property is 100% complete, you may proceed to registration provided that you are fully satisfied that all other conditions of the lending have been complied with.

Attorney Bulletin 06/06 - Securitisation

Please be reminded that it is the responsibility of the partner/conveyancer, nominated as Standard Bank’s power of attorney, to sign the indemnity on our behalf. 

All signatories, including witnesses, are to:

·       sign the documents in full in the spaces provided;

·       initial each page of the document including the first page;

·       insert any addresses as required; and

·       ensure that all alterations have been initialled by the signatories and witnesses as required.

ABSA - 3-Month Payment Holiday Option

 

Absa Home Loans is constantly looking for new and innovative ways to grow the business and consequently developed a campaign with various special offers and incentives that will run from 1 August 2006 to 31 October 2006.

One of the product offerings of the campaign is a 3-Month Payment Holiday Option. The customer can apply for this product from 1 August 2006 to 31 October 2006. 

This option allows the customer to choose a maximum of 3 months as a payment holiday. During this period the customer’s home loan instalment will be stopped and later on re-instated after the payment break is complete.

ABSA - Regibond - Fica

FICA is a requirement as set out by Government and needs to be met by all financial institutions. 

It has to be borne in mind that the majority of customers are going to move once registration takes effect, FICA specifically states that the customer’s address and identity needs to be verified and that if a change of address takes place then FICA has to be done again. 

Absa has to ensure that its customers received the best customer service at all times.  It has therefore been decided to expand the Affidavit to include the customer’s future address details, as well as an anticipated date of occupation.

The Affidavit and current supporting FICA document process remains as is. The inclusion of the new residential address must be completed by the customer. If the customer is, however, not able to provide the FICA documentation to support this it will be acceptable, considering that the customer is not living in the new property yet. 

The reason for not insist on supporting documents to verify the new address is due to the fact that the customer is registering a bond over the property and Absa will then have the title deed and bond to verify the new address.

ABSA - Procedure to follow with Endorsements: Section 45 and Section 57

Where a customer approaches an attorney directly to perform an endorsement, the customer must be referred to the Absa branch to apply for a loan to take over the old account and to have an endorsement registered. 

A new account number will be created by the Processing Unit and the instruction will be forwarded to the attorneys via the RegiBond System. The old account number will have to be closed.

ABSA - Bridging finance - Early payout of further advance  

Absa Home Loans continuously strive to improve the range of products and services available to home buyers and we are pleased to advise that an enhanced Further Advance service offering is being launched – funds will now be available to customers earlier in the process than before.

Currently customers can only have access to the funds under a Further Advance once the additional bond has been registered. With Absa’s new “Early Payout of Further Advance” service, up to 80% of the Further Advance can be paid to the customer, once confirmation has been received from the bond attorneys that all conditions have been met and the relevant documents for the Further Advance have been signed prior to registration of the Further Bond. This means that customers can have money earlier than before.

ABSA - Bridging Finance on Sale of Existing Properties and Switched Home Loans

Absa Home Loans has launched a full residential property based Bridging Finance product on 27 March 2006.

The purpose of this communication is to re-iterate the procedure with regard to processing Bridging Finance applications to the panel.
